1. Acceptance of Terms

By accessing or using TheDress.ai ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you ("User", "you") and [COMPANY LEGAL NAME] ("TheDress.ai", "we", "us", "our"), a company registered in Malaysia.

We recommend that you read these Terms carefully before using the Service. Your continued use of the Service following any updates to these Terms constitutes your acceptance of those changes.

2. Service Description

TheDress.ai is an AI-powered wedding visualization application. The Service allows users to upload selfie photographs and uses Google Gemini AI to generate images depicting the user in wedding attire, including wedding dresses and suits.

The Service is offered under the following tiers:

• Free Tier. Users may generate a limited number of AI wedding images at standard resolution. Free-tier images include a visible watermark identifying them as generated by TheDress.ai.
• Paid Credits. Users may purchase credits to generate high-definition (HD) images without watermarks. Credits provide access to higher resolution outputs, additional style options, and priority processing.

Specific features, output quality, and credit pricing are detailed on our website and may be updated from time to time.

3. Account Registration

To use the Service, you must create an account. By registering, you represent and warrant that:

• You are at least 18 years of age. The Service is not intended for use by anyone under the age of 18.
• All information you provide during registration is accurate, current, and complete. You agree to update your information promptly if it changes.
• You will maintain only one account per person. Creating multiple accounts to circumvent restrictions, abuse free-tier limits, or for any other purpose is prohibited.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these requirements.

4. Acceptable Use Policy

You agree to use the Service responsibly and in compliance with all applicable laws. The following rules apply to your use of the Service:

You MUST:

• Only upload photographs of yourself, or photographs of another person for whom you have obtained explicit, informed consent from the person depicted.

You MUST NOT:

• Upload photographs of minors (persons under the age of 18) under any circumstances.
• Attempt to generate explicit, sexual, violent, or illegal content using the Service.
• Use the Service to create non-consensual intimate imagery of any person.
• Attempt to circumvent, bypass, or disable any safety filters, content moderation systems, or other protective measures implemented by the Service.
• Use automated tools, bots, scripts, or scrapers to access, interact with, or extract data from the Service.
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying technology of the Service.
• Scrape, harvest, or collect data from the Service by any automated or manual means for purposes not expressly permitted by these Terms.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account, removal of your content, and, where appropriate, referral to law enforcement authorities.

5. Content Ownership and Licenses

Your Uploaded Photos

You retain full ownership of any photographs you upload to the Service. We do not claim any ownership rights over your uploaded content.

By uploading a photograph, you grant TheDress.ai a limited, non-exclusive, non-transferable, revocable license to process, reproduce, and temporarily store the photograph solely for the purpose of providing the Service to you. This license terminates when you delete your content or close your account, subject to any reasonable backup or archival retention period.

AI-Generated Images

TheDress.ai does not claim ownership of images generated through the Service.

Upon generation, you are granted a non-exclusive, worldwide, royalty-free license to use, download, share, and display the AI-generated images for personal, non-commercial purposes. This license does not extend to commercial use, resale, or redistribution for profit without our prior written consent.

AI-Generated Content Labeling

In compliance with the EU AI Act and applicable transparency requirements, all AI-generated images produced by the Service are labeled and identified as AI-generated content. You agree not to remove, obscure, or alter any such labels or metadata embedded in the generated images.

6. Credits and Payments

• Credits may be purchased through the Service to unlock premium features, including HD image generation.
• All payments are processed securely by Stripe. By making a purchase, you also agree to Stripe's terms of service.
• Credits are non-refundable. Once purchased, credits cannot be returned, exchanged, or redeemed for cash, except where required by applicable law.
• Credits have no cash value and may not be transferred to another account.
• We reserve the right to modify pricing for credits at any time. Any price changes will be communicated to users with reasonable notice. Price changes will not affect credits already purchased.
• We reserve the right to set expiration periods for purchased credits. Any applicable expiration terms will be clearly communicated at the time of purchase.

7. Content Moderation

We are committed to maintaining a safe and responsible platform. To that end:

• The Service employs automated safety filters and content moderation systems to detect and prevent the generation of prohibited content, including but not limited to explicit, violent, or otherwise harmful imagery.
• We reserve the right to review, flag, and remove any content — including uploaded photos and generated images — that we determine, in our sole discretion, violates these Terms, our Acceptable Use Policy, or applicable law.
• We reserve the right to suspend or permanently terminate the accounts of users who violate these Terms or who repeatedly trigger content moderation systems.
• Content moderation decisions are made at our discretion and are generally final, though users may contact us to appeal a decision.

8. Intellectual Property

• All intellectual property rights in the Service — including but not limited to the software, algorithms, user interface, design, branding, trademarks, and documentation — are and remain the exclusive property of TheDress.ai and its licensors.
• Nothing in these Terms grants you any right, title, or interest in the Service's intellectual property, except for the limited right to use the Service in accordance with these Terms.
• Your content (uploaded photographs and the rights therein) remains your property, subject to the licenses granted in Section 5.

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

To the fullest extent permitted by applicable law, TheDress.ai disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any warranty that the Service will be uninterrupted, error-free, or secure.
• Any warranty regarding the accuracy, quality, or realism of AI-generated images. AI technology may produce imperfect, unexpected, or unrealistic results. We do not guarantee that generated images will accurately represent your likeness, body type, skin tone, or any other physical attribute.
• Any warranty regarding the suitability of generated images for any particular use.

You acknowledge that AI-generated content is produced by machine learning models and may contain artifacts, distortions, or inaccuracies. You use the Service and rely on its outputs at your own discretion and risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law:

• The total aggregate liability of TheDress.ai, its directors, officers, employees, and affiliates, arising out of or in connection with your use of the Service, shall not exceed the total amount you have paid to TheDress.ai in the twelve (12) months immediately preceding the event giving rise to the claim.
• In no event shall TheDress.ai be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, reputation, or other intangible losses, regardless of whether such damages were foreseeable or whether TheDress.ai was advised of the possibility of such damages.
• These limitations apply to all claims, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory.

If you have not made any payments to TheDress.ai, our total liability to you shall not exceed fifty Malaysian Ringgit (RM 50).

11. Indemnification

You agree to indemnify, defend, and hold harmless TheDress.ai, its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your misuse of the Service or violation of these Terms.
• Your uploading of photographs of another person without their explicit consent.
• Your use of AI-generated images in a manner that infringes the rights of any third party.
• Any illegal activity conducted through or facilitated by your use of the Service.
• Any content you upload or generate that violates applicable law or the rights of others.

12. Termination

• By you. You may terminate your account at any time by using the account deletion feature in the Service or by contacting us. Upon termination, your right to use the Service ceases immediately.
• By us. We may suspend or terminate your account at any time, with or without cause, and with or without notice, including but not limited to cases where you violate these Terms.
• Effect of termination. Upon account closure, we will delete your uploaded photographs and generated images within a reasonable period, subject to any legal obligations requiring us to retain certain data. Any unused credits at the time of termination are forfeited and non-refundable, except where prohibited by applicable law.
• Sections of these Terms that by their nature should survive termination (including but not limited to Sections 5, 9, 10, 11, and 13) shall survive any termination or expiration of these Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.

Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Malaysia.

Consumer rights carve-out. Nothing in these Terms is intended to limit or exclude any statutory consumer protection rights that you may have under the laws of your jurisdiction and that cannot be lawfully waived or limited by contract. Where such mandatory consumer protections apply, our liability is limited only to the extent permitted by applicable law.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last updated" date at the top of this document.
• Provide you with at least thirty (30) days' prior notice of material changes, via email to the address associated with your account or through a prominent notice within the Service.

Your continued use of the Service after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the Service and close your account before the changes take effect.
